{"id":1014,"date":"2024-06-27T06:51:42","date_gmt":"2024-06-27T06:51:42","guid":{"rendered":"https:\/\/bulu-ip.com\/?p=1014"},"modified":"2024-06-27T06:59:30","modified_gmt":"2024-06-27T06:59:30","slug":"myanmar-patent-law-big-changes-for-businesses-and-inventors","status":"publish","type":"post","link":"https:\/\/bulu-ip.com\/en\/myanmar-patent-law-big-changes-for-businesses-and-inventors\/","title":{"rendered":"Myanmar Patent Law: Big Changes for Businesses and Inventors!"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"1014\" class=\"elementor elementor-1014\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7ebb3045 e-flex e-con-boxed e-con e-parent\" data-id=\"7ebb3045\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t<div class=\"elementor-element elementor-element-5765d056 e-con-full e-flex e-con e-child\" data-id=\"5765d056\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4e2fcd03 elementor-widget elementor-widget-text-editor\" data-id=\"4e2fcd03\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><style>p { font-size: 18px;line-height: 1.25; }<\/style><\/p>\n<div>\n<p>The Myanmar Patent Law retrospectively took effect on May 31, 2024, pursuant to the State Administration Council\u2019s Notification No. 106\/2024, dated June 1, 2024.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Subsequently, the Ministry of Commerce issued the Patent Rules under Notification No. 43\/2024, dated June 4, 2024, establishing the procedures for patent-related matters.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Under the newly enacted Patent Law, inventions and utility models will become eligible for registration with the Intellectual Property Department (IPD) to obtain statutory protection only after the official forms, fees and the commencement date for application submissions are announced.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>An invention is eligible for registration under the Patent Law if it meets the following criteria:<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>1. it must be new, meaning it has not been disclosed to the public anywhere by any means before the filing date or priority date if priority is claimed;<\/p>\n<!-- \/wp:paragraph --><!-- wp:list {\"ordered\":true} --><!-- \/wp:list --><!-- wp:list {\"ordered\":true} --><!-- \/wp:list --><!-- wp:paragraph -->\n<p>2. it must involve an inventive step;<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>3. and must be capable of being used within an industry.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>The new Patent Law in Myanmar will become fully operational once the authorities announce the official forms, fees and the commencement date for submissions. \u201cAt that time, individuals and legal entities will be able to apply for registration of their patents under the Patent Law in Myanmar. Following completion of their first examination, the IPD will then proceed to publish the applied for inventions. If there are no objections within 90 days from the date of publication by the IPD, the inventions will be eligible for registration and granted protection under the Patent Law,\u201d said Khin Myo Myo Aye, a senior associate at Tilleke &amp; Gibbins Myanmar Limited in Yangon.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>She added: \u201cAdditionally, the Patent Law recognizes the right to claim priority within one year from the application filing date in any member country of the World Trade Organization (WTO) or the Paris Convention. The law also allows simultaneous filing of international patent applications in Myanmar, enabling inventors to seek protection for their inventions in multiple jurisdictions at the same time through the Patent Cooperation Treaty (PCT). However, these provisions will only come into effect after Myanmar ratifies the Paris Convention and PCT through future announcements. Since Myanmar has been a WTO member since 1995, rights holders can claim priority based on applications filed in any WTO member country once the IPD begins to accept such applications, subject to the specified announcements. This framework affords rights holders the opportunity to assert their rights and priorities at an earlier date than the actual filing date in Myanmar.\u201d<\/p>\n<!-- \/wp:paragraph --><!--
