Russia Prioritizes Patent Examination for Small Technology Enterprises

On November 29, 2024, Russia issued a notice on giving priority to the patent examination applications (including inventions and utility models) of small technology enterprises.

When applying for invention and utility model patents, small technology enterprises can use the following preferential policies:

1. Small technology companies can submit a request for prioritized examination of inventions or utility models, which, if they meet the prioritized examination conditions, will shorten the time to complete the first act of substantive examination (such as issuing an examination notice, examination decision, etc.). For invention applications, no later than 2 months from the date of meeting the prioritized examination conditions or the date of meeting the substantive examination request, whichever is later. For utility models, no later than 1 month from the date of meeting the prioritized examination conditions.

Small technology companies that wish to apply for foreign patents through the PCT route can request priority acceptance of patent examination. The Russian Intellectual Property Office will forward a copy of the priority international application to the World Intellectual Property Office (WIPO). The date for deciding to accept and forward the international application documents is determined in accordance with Article 1395 of the Civil Code of the Russian Federation.

There is no restriction on the form of the above two applications, but the small technology enterprise certification materials must be submitted. There is no charge for submitting or reviewing the certification materials.
