On December 17, 2024, the UK government will launch a ten-week public consultation on proposals for copyright and AI (artificial intelligence) legal reforms (December 17, 2024 to February 25, 2025).
The new proposal aims to provide legal certainty for the creative and AI industries to use copyrighted material in model training, supporting innovation and promoting the development of related fields.
Currently, uncertainty in UK copyright law in the field of AI is preventing the creative and AI industries from realizing their full potential; it may make it difficult for creators to control the use of their works or to obtain compensation for the use of their works. AI companies also face legal risks, which leads to limited investment, innovation and technology adoption in AI.
To address the above issues, the proposal suggests adding a new exception for “AI training for commercial purposes” to copyright law, and allowing rights holders to retain their own rights and control the use of content.
At the same time, combined with transparency requirements, rights holders will have greater certainty and control to help them reach licensing agreements. This will also provide clear guidance for AI developers to ensure that they can widely access the materials they need in the UK.
Objectives of the copyright and AI consultation:
1. Ensure the fair use of copyrighted materials in model training, provide legal certainty to support innovation in the creative and AI industries, and promote the development of these two key industries.
2. Strengthen creators’ control over their works and their ability to be compensated for the use of their works.
3. Require AI companies to increase transparency on the data used to train AI models and how AI-generated content is labeled.
4. Enabling AI developers to have broad access to materials for training world-leading models in the UK, while legal certainty will promote the application of AI across the economy.
The proposed reforms will help unleash the full potential of the creative and AI sectors, stimulate innovation, investment and prosperity in the UK, and help the UK government achieve its G7 highest sustained growth target.
