}<\/style>\n<\/p>\n<div>\n<p><span style=\"text-align: var(--text-align);\">The &#8220;Implementing Rules for the Patent Law of the People&#8217;s Republic of China&#8221; and the &#8220;China Patent Examination Guidelines&#8221; (2023) issued on December 21, 2023 have come into effect on January 20, 2024.<\/span><\/p>\n<\/div>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>In order to better guide China&#8217;s patent application and examination practices, the key contents of this revision of the examination guidelines are now introduced and interpreted.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading --><\/p>\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u4e00\u3001\u4e13\u5229\u7533\u8bf7\u3001\u5ba1\u67e5\u7a0b\u5e8f\u76f8\u5173\u89c4\u5b9a\u7684\u4fee\u6539<\/mark><\/h2>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><strong>1.1\u65b0\u589e\u63f4\u5f15\u52a0\u5165\u76f8\u5173\u89c4\u5b9a<\/strong><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\uff081\uff09\u5e94\u5f53\u5728\u9996\u6b21\u9012\u4ea4\u4e13\u5229\u7533\u8bf7\u65f6\u8981\u6c42\u5728\u5148\u7533\u8bf7\u7684\u4f18\u5148\u6743\uff0c\u63d0\u51fa\u63f4\u5f15\u52a0\u5165\u58f0\u660e\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\uff082\uff09\u5e94\u5728\u9996\u6b21\u9012\u4ea4\u4e13\u5229\u7533\u8bf7\u4e4b\u65e5\u8d77\u4e24\u4e2a\u6708\u5185\u6216\u8005\u5728\u4e2d\u56fd\u56fd\u5bb6\u77e5\u8bc6\u4ea7\u6743\u5c40\u6307\u5b9a\u7684\u671f\u9650\u5185\uff0c\u63d0\u4ea4\u786e\u8ba4\u63f4\u5f15\u52a0\u5165\u58f0\u660e\uff0c\u8865\u4ea4\u76f8\u5173\u6587\u4ef6\u3002\u5176\u4e2d\u8865\u4ea4\u7684\u7533\u8bf7\u6587\u4ef6\u5185\u5bb9\u5e94\u5f53\u5305\u542b\u5728\u5728\u5148\u7533\u8bf7\u6587\u4ef6\u526f\u672c\u548c\u5176\u4e2d\u6587\u8bd1\u6587\u4e4b\u4e2d\u3002\u5ba1\u67e5\u6307\u5357\u76f8\u5e94\u5730\u5220\u9664\u4e86\u5bf9PCT\u5b9e\u65bd\u7ec6\u5219\u6709\u5173\u63f4\u5f15\u52a0\u5165\u6761\u6b3e\u4f5c\u51fa\u4fdd\u7559\u7684\u8868\u8ff0\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><strong>1.2\u4fee\u6539\u4f18\u5148\u6743\u76f8\u5173\u89c4\u5b9a<\/strong><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\uff081\uff09\u65b0\u589e\u4f18\u5148\u6743\u6062\u590d<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\u8bf7\u6c42\u6062\u590d\u4f18\u5148\u6743\u7684\u65f6\u673a\u4e3a\u4f18\u5148\u6743\u671f\u9650\u5c4a\u6ee1\u4e4b\u65e5\u8d77\u4e24\u4e2a\u6708\u5185\uff0c\u4e14\u5728\u4e2d\u56fd\u56fd\u5bb6\u77e5\u8bc6\u4ea7\u6743\u5c40\u4f5c\u597d\u516c\u5e03\u51c6\u5907\u4e4b\u524d\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\u63d0\u4ea4\u7684\u6587\u4ef6\u5305\u62ec\u6062\u590d\u4f18\u5148\u6743\u8bf7\u6c42\u4e66\u53ca\u5176\u4ed6\u9700\u8981\u7684\u6587\u4ef6\uff0c\u5982\u5728\u5148\u7533\u8bf7\u6587\u4ef6\u526f\u672c\u3001\u4f18\u5148\u6743\u8f6c\u8ba9\u8bc1\u660e\u6587\u4ef6\u7b49\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\u7f34\u7eb3\u7684\u8d39\u7528\u5305\u62ec\u6062\u590d\u6743\u5229\u8bf7\u6c42\u8d39\u3001\u4f18\u5148\u6743\u8981\u6c42\u8d39\u3002\u5ba1\u67e5\u6307\u5357\u76f8\u5e94\u5730\u5220\u9664\u4e86\u5bf9PCT\u5b9e\u65bd\u7ec6\u5219\u6709\u5173\u4f18\u5148\u6743\u6062\u590d\u6761\u6b3e\u4f5c\u51fa\u4fdd\u7559\u7684\u8868\u8ff0\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\uff082\uff09\u65b0\u589e\u4f18\u5148\u6743\u8981\u6c42\u7684\u589e\u52a0\u6216\u8005\u6539\u6b63<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\u63d0\u51fa\u65f6\u673a\u4e3a\u81ea\u4f18\u5148\u6743\u65e5\u8d77\u5341\u516d\u4e2a\u6708\u5185\u6216\u8005\u7533\u8bf7\u65e5\u8d77\u56db\u4e2a\u6708\u5185\uff0c\u4e14\u5728\u4e2d\u56fd\u56fd\u5bb6\u77e5\u8bc6\u4ea7\u6743\u5c40\u4f5c\u597d\u516c\u5e03\u51c6\u5907\u4e4b\u524d\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\u9700\u63d0\u4ea4\u589e\u52a0\u6216\u8005\u6539\u6b63\u4f18\u5148\u6743\u8981\u6c42\u8bf7\u6c42\u4e66\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\u9488\u5bf9\u589e\u52a0\u4f18\u5148\u6743\u8981\u6c42\u7684\u60c5\u5f62\uff0c\u9700\u8981\u7f34\u7eb3\u4f18\u5148\u6743\u8981\u6c42\u8d39\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\uff083\uff09\u5b8c\u5584\u5176\u4ed6\u4f18\u5148\u6743\u624b\u7eed\u8981\u6c42<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>The deadline for submitting copies of prior application documents and priority transfer certificates for invention and utility model patent applications has been relaxed, and &#8220;should be submitted within three months from the date of filing the subsequent application&#8221; is changed to &#8220;should be submitted on the priority date (required If there are multiple priorities, it shall be submitted within 16 months from the earliest priority date.&#8221;<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><strong>1.3\u4fee\u6539\u4e0d\u4e27\u5931\u65b0\u9896\u6027\u7684\u5bbd\u9650\u671f\u76f8\u5173\u89c4\u5b9a<\/strong><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>(1) Article 24 of the Patent Law adds a new grace period situation that does not lose novelty, that is, &#8220;when a national emergency or extraordinary situation occurs, the patent is disclosed for the first time for the purpose of public interest.&#8221; The review guide details relevant rules and clarifies that relevant certification materials should be issued by relevant departments of the people&#8217;s government at or above the provincial level.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\uff082\uff09\u9002\u5e94\u4e13\u5229\u6cd5\u5b9e\u65bd\u7ec6\u5219\u7b2c\u4e09\u5341\u4e09\u6761\u7b2c\u4e8c\u6b3e\u7684\u4fee\u6539\uff0c\u6269\u5927\u4e0d\u4e27\u5931\u65b0\u9896\u6027\u7684\u5bbd\u9650\u671f\u4e2d\u201c\u5b66\u672f\u4f1a\u8bae\u6216\u8005\u6280\u672f\u4f1a\u8bae\u201d\u7684\u4f1a\u8bae\u79cd\u7c7b\u8303\u56f4\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>For the situation of &#8220;exhibiting for the first time at an international exhibition sponsored or recognized by the Chinese government&#8221;, the scope of the issuing unit of certification materials has been expanded, and on the basis of the original &#8220;should be issued by the exhibition organizer&#8221;, &#8220;issued by the exhibition organizing committee&#8221; color: #705b90;\">\u4e8c\u3001\u5173\u4e8e\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u5b9e\u8d28\u5ba1\u67e5\u4e00\u822c\u6027\u89c4\u5b9a\u7684\u4fee\u6539<\/mark><\/h2>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><strong>2.1\u6839\u636e\u4e13\u5229\u6cd5\u53ca\u5176\u5b9e\u65bd\u7ec6\u5219\u8fdb\u884c\u4e86\u8054\u52a8\u6027\u4fee\u6539<\/strong><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>\u5ba1\u67e5\u6307\u5357\u89c4\u5b9a\uff0c\u5728\u4e09\u79cd\u4e13\u5229\u7684\u521d\u6b65\u5ba1\u67e5\u8303\u56f4\u3001\u590d\u5ba1\u548c\u65e0\u6548\u5ba3\u544a\u7a0b\u5e8f\u3001\u4e13\u5229\u6743\u8bc4\u4ef7\u62a5\u544a\u5236\u5b9a\u7b49\u76f8\u5173\u89c4\u5b9a\u4e2d\u589e\u52a0\u5bf9\u4e8e\u8bda\u5b9e\u4fe1\u7528\u539f\u5219\u7684\u5ba1\u67e5\uff0c\u4ee5\u6b64\u5f62\u6210\u4e00\u4e2a\u5168\u9762\u3001\u7cfb\u7edf\u7684\u89c4\u5236\u4f53\u7cfb\u3002<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><strong>2.2\u5bf9\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u7684\u5b9e\u8d28\u5ba1\u67e5\u89c4\u5219\u8fdb\u884c\u4f18\u5316\u548c\u5b8c\u5584<\/strong><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Regarding the cited documents in the background art, when the cited document is a patent document, it is stipulated that &#8220;the publication date of the cited patent document cannot be later than the publication date of this application&#8221;, which unifies the requirements for the publication date of cited Chinese and foreign patent documents.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>In the novelty section of the Examination Guidelines, in the case of Article 24 (1) or (4) of the Patent Law, if another person learns the contents of the invention and then discloses it again, the provisions are the same as the corresponding first time. Disclosure is regarded as the same act, and the patent application will not lose novelty due to the above-mentioned re-publication act. In the inventiveness section of the Examination Guidelines, the rules for determining the closest prior art and determining the technical problem actually solved by the invention in the &#8220;three-step method&#8221; are improved and explained with examples.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><strong>2.3\u4e3a\u9002\u5e94\u65b0\u9886\u57df\u65b0\u4e1a\u6001\u53d1\u5c55\u3001\u56de\u5e94\u521b\u65b0\u4e3b\u4f53\u8bc9\u6c42\uff0c\u5bf9\u5b9e\u8d28\u5ba1\u67e5\u6807\u51c6\u8fdb\u884c\u9002\u5e94\u6027\u4fee\u6539<\/strong><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>The Examination Guidelines stipulate that &#8220;information processing methods in which all steps are implemented by computers and other devices&#8221; do not fall within the diagnostic methods specified in Article 25, Paragraph 1, Item (3) of the Patent Law. In addition, the Internet has increasingly become an important channel for information dissemination. Among the relevant provisions on existing technology, the review guidelines provide separate provisions for materials existing on the Internet or other online databases, clarifying that the date of publication is generally based on the date of release, unless there is other evidence.
