From May 2011 to June 2012 (during the dispute period), there were email exchanges between the inventor and the plaintiff company discussing the content of patent technology solutions. Afterwards, the inventor, as the applicant, applied for a patent for the technology containing the relevant invention points in the disputed email correspondence, and later changed the patent applicant to the &#8220;defendant company&#8221;. Therefore, the plaintiff company filed a lawsuit requesting that the patent in question be awarded to the plaintiff company. This case was tried by two levels of courts and ultimately rejected the plaintiff company&#8217;s lawsuit request.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7137d2 elementor-widget elementor-widget-text-editor\" data-id=\"e7137d2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #705b90;\"><strong>\u6b64\u65f6\u6709\u4eba\u4f1a\u95ee\uff0c\u660e\u660e\u662f\u539f\u544a\u516c\u53f8\u51fa\u94b1\u59d4\u6258\u7684\u6280\u672f\u5f00\u53d1\uff0c\u6700\u540e\u4e3a\u4f55\u5224\u51b3\u539f\u544a\u8d25\u8bc9\u5462\uff1f<\/strong><\/span><\/p><p>\u5224\u51b3\u4e3b\u8981\u4f9d\u636e\u53cc\u65b9\u7b7e\u8ba2\u7684\u5408\u540c\u3002<span style=\"color: #705b90;\"><strong> \u53d1\u660e\u4eba\u548c\u539f\u544a\u516c\u53f8\u4e4b\u95f4\u5171\u5b58\u5728\u4e24\u4efd\u5408\u540c\uff0c\u800c\u8fd9\u4e24\u4efd\u5408\u540c\u4e2d\uff0c\u65e2\u6ca1\u6709\u660e\u786e\u53d1\u660e\u4eba\u4e0e\u539f\u544a\u516c\u53f8\u4e4b\u95f4\u7684\u5de5\u4f5c\u5173\u7cfb\uff08\u5373\u6ca1\u6709\u8bc1\u636e\u8bc1\u660e\u53d1\u660e\u4eba\u4e0e\u539f\u544a\u516c\u53f8\u4e4b\u95f4\u7684\u5de5\u4f5c\u5173\u7cfb\u662f\u52b3\u52a8\u5173\u7cfb\u6216\u662f\u4e34\u65f6\u5de5\u4f5c\u5173\u7cfb\uff09\uff0c\u4e5f\u6ca1\u6709\u57fa\u4e8e\u8be5\u5de5\u4f5c\u5173\u7cfb\u5f62\u6210\u7684\u76f8\u5173\u6280\u672f\u6210\u679c\u7684\u5f52\u5c5e\u7684\u610f\u601d\u8868\u8fbe\u3002<\/strong><\/span><\/p><p>Although the plaintiff company provided the inventor with monthly salary and housing allowance, paid social security, reimbursed travel expenses, and listed the inventor as the new product development director and product manager, there were also weekly reports and exchanges in their work. However, the Supreme Court held that the inventor&#8217;s identity as a university teacher has not changed; The above evidence is insufficient to establish a labor relationship or temporary work relationship in the sense of &#8220;service invention&#8221; between the inventor and the plaintiff company, and cannot serve as a legal and factual basis for the plaintiff company to claim ownership of the patent in question on the grounds of service invention.<\/p><p>\u53d1\u660e\u4eba\u4e0e\u5355\u4f4d\u4e4b\u95f4\u5b58\u5728\u52b3\u52a8\u5173\u7cfb\u6216\u4e34\u65f6\u5de5\u4f5c\u5173\u7cfb\uff0c\u662f\u8ba4\u5b9a\u804c\u52a1\u53d1\u660e\u7684\u524d\u63d0\u3002 <span style=\"color: #705b90;\"><strong>\u52b3\u52a8\u5173\u7cfb\u6216\u4e34\u65f6\u5de5\u4f5c\u5173\u7cfb\u7684\u5224\u65ad\u6807\u51c6\u5728\u4e8e\u5355\u4f4d\u662f\u5426\u53d6\u5f97\u4e86\u5bf9\u53d1\u660e\u4eba\u7684\u52b3\u52a8\u652f\u914d\u6743\uff0c\u5305\u62ec\u5b8c\u6210\u53d1\u660e\u521b\u9020\u7684\u521b\u9020\u6027\u52b3\u52a8\u5728\u5185\u7684\u52b3\u52a8\u652f\u914d\u6743\u3002<\/strong> <\/span>If there is only a general cooperative relationship between the unit and the inventor, and they do not have the right to dispose of the inventor&#8217;s labor, the relevant inventions and creations of the inventor do not belong to service inventions and creations.<\/p><p>\u6309\u7167\u4e13\u5229\u6cd5\u89c4\u5b9a\uff0c\u5408\u4f5c\u6216\u59d4\u6258\u7814\u53d1\u8fc7\u7a0b\u4e2d\u7684\u4e13\u5229\uff08\u7533\u8bf7\uff09\u6743\u5e94\u4ee5\u5408\u540c\u7ea6\u5b9a\u4e3a\u51c6\uff0c <span style=\"color: #705b90;\"><strong>\u6ca1\u6709\u7ea6\u5b9a\u7684\uff0c\u5b8c\u6210\u53d1\u660e\u521b\u9020\u7684\u4eba\u53ef\u4ee5\u4f5c\u4e3a\u4e13\u5229\u7533\u8bf7\u4eba\u3002<\/strong><\/span><\/p><h2>\u542f\u793a<\/h2><p>\u6b64\u6848\u4f8b\u8ba9\u6211\u4eec\u8b66\u9192\uff1a<\/p><p>\u4e00\u3001\u7b7e\u8ba2\u5408\u540c\u65f6\uff0c\u4e00\u5b9a\u8981\u7ea6\u5b9a\u597d\u77e5\u8bc6\u4ea7\u6743\u7684\u5f52\u5c5e\uff0c\u5426\u5219\uff0c\u518d\u70ed\u7684\u5fc3\u80a0\uff0c\u4e5f\u4e0d\u80fd\u6539\u53d8\u6cd5\u5f8b\u7684\u89c4\u5b9a\uff0c\u9020\u6210\u82b1\u94b1\u53c8\u5403\u4e8f\u7684\u5c34\u5c2c\u5c40\u9762\u3002<\/p><p>2\u3001 Enterprises and other market entities that want to engage in innovative research and development can refer to the content of the &#8220;Enterprise Intellectual Property Management Specification GB\/T29490&#8221; (national standard) and &#8220;Innovation Management System ISO56001&#8221; (international standard) to independently improve internal
