After accepting the commission, the lawyer sought a settlement from the plaintiff, but the plaintiff demanded a high settlement amount, which Company A could not accept and had no choice but to respond to the lawsuit. During multiple communications with Company A regarding the specific details of the case, the lawyer learned that the relevant documents were only served to Company A via email. Therefore, in September 2018, the lawyer explicitly proposed a motion to the court to dismiss the plaintiff&#8217;s complaint, stating that the method of service of official documents did not comply with the relevant provisions of the Hague Convention. The court held that the plaintiff failed to fulfill its due diligence obligations on the premise of obtaining the detailed address of defendant A company under certain conditions. The final judgment dismissed the plaintiff&#8217;s lawsuit and immediately unfrozen A company&#8217;s account.<br \/>\u300a\u6d77\u7259\u9001\u8fbe\u516c\u7ea6\u300b\u5373\u300a\u5173\u4e8e\u5411\u56fd\u5916\u9001\u8fbe\u6c11\u4e8b\u6216\u5546\u4e8b\u53f8\u6cd5\u6587\u4e66\u548c\u53f8\u6cd5\u5916\u6587\u4e66\u516c\u7ea6\u300b\u89c4\u5b9a\u7684\u9001\u8fbe\u65b9\u5f0f\u4e49\u52a1\u76ee\u524d\u5f97\u5230\u56fd\u9645\u793e\u4f1a\u516c\u8ba4\u3002\u76ee\u524d\u8be5\u516c\u7ea6\u670979\u4e2a\u7f14\u7ea6\u56fd\u3002\u7f8e\u56fd\u81ea1965\u5e74\u8d77\u6210\u4e3a\u8be5\u516c\u7ea6\u7684\u7f14\u7ea6\u56fd\uff0c1991\u5e74\u6211\u56fd\u52a0\u5165\u8be5\u516c\u7ea6\u3002<\/p>\n<p><span style=\"color: #705b90;\"><strong>The prerequisite for applying the Hague Convention on Service of Service is that the recipient&#8217;s valid address can be obtained through effective means. In this case, Company A&#8217;s online store page was able to retrieve their actual contact address and conduct tracking, but the plaintiff still chose electronic delivery and did not fulfill their responsibility of researching the defendant&#8217;s actual address.<\/strong> <\/span>Therefore, the court found that the plaintiff&#8217;s use of email to serve documents without making reasonable efforts to confirm the defendant&#8217;s actual address did not comply with the provisions of the Hague Service of Service Convention.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b4c9f75 elementor-widget elementor-widget-heading\" data-id=\"b4c9f75\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u7ecf\u9a8c\u542f\u793a<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8feba69 elementor-widget elementor-widget-text-editor\" data-id=\"8feba69\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u8fd1\u5e74\u6765\uff0c\u6211\u56fd\u8de8\u5883\u7535\u5546\u5728\u56fd\u5916\u7ecf\u5e38\u906d\u53d7\u7c7b\u4f3c\u7684\u77e5\u8bc6\u4ea7\u6743\u8bc9\u8bbc\uff0c\u7531\u4e8e\u6d89\u6848\u91d1\u989d\u8f83\u4f4e\uff0c\u800c\u5e94\u8bc9\u6210\u672c\u8d39\u7528\u9ad8\u6602\uff0c\u6240\u4ee5\u5927\u90e8\u5206\u4f01\u4e1a\u901a\u5e38\u9009\u62e9\u5ead\u5916\u548c\u89e3\u3002\u672c\u6848\u901a\u8fc7\u7a0b\u5e8f\u6297\u8fa9\u83b7\u80dc\u8f83\u4e3a\u7f55\u89c1\u3002<br \/><span style=\"color: #705b90;\"><strong>\u7f8e\u56fd\u8054\u90a6\u6c11\u4e8b\u8bc9\u8bbc\u89c4\u5219\u8981\u6c42\uff1a\u5f53\u539f\u544a\uff08\u4e0d\u8bba\u662f\u5426\u4e3a\u7f8e\u56fd\u516c\u53f8\uff09\u5728\u7f8e\u56fd\u8054\u90a6\u6cd5\u9662\u63d0\u8d77\u8bc9\u8bbc\u65f6\uff0c\u539f\u544a\u9700\u5c06\u8bc9\u72b6\u526f\u672c\u548c\u4f20\u7968\u9001\u8fbe\u88ab\u544a\u3002<\/strong> <\/span>\u5982\u679c\u88ab\u544a\u4f4d\u4e8e\u7f8e\u56fd\u5883\u5185\u6216\u5728\u7f8e\u56fd\u5883\u5185\u6709\u8425\u4e1a\u5730\u70b9\uff0c\u9001\u8fbe\u8bc9\u72b6\u901a\u5e38\u5bb9\u6613\u5b8c\u6210\u3002\u5f53\u88ab\u544a\u4e0d\u5728\u7f8e\u56fd\u5883\u5185\u65f6\uff0c\u9001\u8fbe\u53ef\u80fd\u4f1a\u8f83\u4e3a\u56f0\u96be\u3002\u4e0d\u5c11\u7f8e\u56fd\u539f\u544a\u4f1a\u7ed5\u8fc7\u5b9e\u9645\u6587\u4e66\u9001\u8fbe\uff0c\u9009\u62e9\u7535\u5b50\u9001\u8fbe\u65b9\u5f0f\u3002\u76ee\u524d\u6211\u56fd\u5b98\u65b9\u4e5f\u672a\u8ba4\u53ef\u5883\u5916\u6cd5\u5f8b\u6587\u4e66\u901a\u8fc7\u7535\u5b50\u90ae\u4ef6\u9001\u8fbe\u3002 <span style=\"color: #705b90;\"><b>\u7f8e\u56fd\u662f\u5224\u4f8b\u6cd5\u56fd\u5bb6\uff0c\u5148\u524d\u6210\u529f\u6297\u8fa9\u7684\u6848\u4f8b\u5bf9\u540e\u7eed\u7c7b\u4f3c\u6848\u4ef6\u5177\u6709\u6307\u5bfc\u610f\u4e49\uff0c\u4f01\u4e1a\u9047\u5230\u6b64\u7c7b\u60c5\u51b5\u53ef\u4ee5\u63f4\u5f15\u5148\u524d\u5224\u4f8b\u8fdb\u884c\u6297\u8fa9\u3002 <\/b><\/span>\u56e0\u6b64\uff0c\u5546\u6237\u5728\u906d\u9047\u8bc9\u8bbc\u65f6\u5e94\u79ef\u6781\u5e94\u8bc9\uff0c\u51c6\u786e\u5229\u7528\u76f8\u5173\u6cd5\u5f8b\u6cd5\u89c4\u7ef4\u62a4\u81ea\u8eab\u5408\u6cd5\u6743\u76ca\u3002<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div
