If the claim records that a technical means utilizing natural laws is used to solve the technical problem to be solved, and thereby obtains a technical effect that conforms to natural laws, then the solution defined in the claim belongs to the technical solution described in Article 2, Paragraph 2 of the Patent Law.<\/p>\n\n\n\n<p>If pure business methods\u00a0be\u00a0patented, it is a pure intellectual activity rule and cannot be protected because it does not belong to the subject of patent protection, such as &#8220;retail business model&#8221; and &#8220;diversified marketing strategy&#8221;. However, if such a business method is based on information technology, it can meet the requirements of the subject of patent protection, such as &#8220;a kind of *** automation system&#8221;.<\/p>\n\n\n\n<p>\u6b64\u7c7b\u65b9\u6cd5\u4e13\u5229\u5728\u64b0\u5199\u65f6\u8981\u8003\u8651\u5230\u5c06\u6765\u7ef4\u6743\u53d6\u8bc1\u7684\u96be\u6613\u95ee\u9898\uff0c\u867d\u7136\u6cd5\u9662\u5bf9\u6b64\u7c7b\u7684\u65b9\u6cd5\u4e13\u5229\u7684\u4e13\u5229\u6743\u4eba\u9002\u5f53\u653e\u677e\u4e86\u4e3e\u8bc1\u8d23\u4efb\uff0c\u4f46\u4e13\u5229\u6743\u4eba\u4ecd\u9700\u8fdb\u884c\u4e00\u5b9a\u7684\u4e3e\u8bc1\u3002<\/p>\n\n\n\n<p>\u901a\u5e38\u4e3a\u4e86\u907f\u514d\u521b\u9020\u6027\u95ee\u9898\uff0c\u6709\u4e9b\u4ee3\u7406\u4eba\u4f1a\u5c06\u5177\u4f53\u7b97\u6cd5\u3001\u516c\u5f0f\u7b49\u5199\u5165\u72ec\u6743\uff0c\u8fd9\u79cd\u7b80\u5355\u7c97\u66b4\u7684\u5199\u6cd5\u867d\u7136\u4f7f\u4e13\u5229\u5f97\u5230\u4e86\u6388\u6743\uff0c\u4f46\u6ca1\u6709\u8003\u8651\u4e13\u5229\u6743\u4eba\u5c06\u6765\u7ef4\u6743\u53d6\u8bc1\u7684\u95ee\u9898\uff0c\u5bfc\u81f4\u6709\u4e13\u5229\u5374\u65e0\u6cd5\u5f97\u5230\u4fdd\u62a4\u7684\u5c34\u5c2c\u5c40\u9762\u3002<\/p>\n\n\n\n<p>\u6b64\u7c7b\u4e13\u5229\u7684\u6743\u5229\u8981\u6c42\u64b0\u5199\u65f6\uff0c\u8981\u5c3d\u91cf\u9002\u7528\u5bb9\u6613\u53d6\u8bc1\u7684\u8f93\u5165\u548c\u8f93\u51fa\uff0c\u5e76\u5728\u5b9e\u65bd\u4f8b\u4e2d\u8fdb\u884c\u8f83\u4e3a\u5168\u9762\u7684\u8bf4\u660e\u5e94\u7528\u7684\u5177\u4f53\u573a\u666f\u548c\u8be6\u7ec6\u7684\u6280\u672f\u65b9\u6848\u4ee5\u53ca\u5177\u4f53\u7684\u4f53\u73b0\u5f62\u5f0f\uff0c\u4e3a\u672a\u6765\u7684\u8bc9\u8bbc\u4e70\u4e0b\u4f0f\u7b14\u3002<\/p>\n\n\n\n<p>\u56e0\u6b64\uff0c\u5bf9\u4e8e\u5546\u4e1a\u65b9\u6cd5\u80fd\u5426\u4ee5\u4e13\u5229\u5f62\u5f0f\u4fdd\u62a4\uff0c\u53d6\u51b3\u4e8e\u5176\u662f\u5426\u80fd\u591f\u5229\u7528\u6280\u672f\u65b9\u6848\u8fdb\u884c\u5448\u73b0\uff0c\u5e76\u4ea7\u751f\u6280\u672f\u7684\u6548\u679c\uff0c\u800c\u6b64\u7c7b\u65b9\u6cd5\u4e13\u5229\u5728\u64b0\u5199\u548c\u7b54\u590d\u5ba1\u67e5\u610f\u89c1\u65f6\uff0c\u4e0d\u80fd\u4ee5\u4ece\u6743\u4e2d\u7684\u7b97\u6cd5\u3001\u516c\u5f0f\u201c\u4e00\u5e76\u4e86\u4e4b\u201d\uff0c\u800c\u7b80\u5355\u5730\u8fbe\u5230\u5177\u6709\u521b\u9020\u6027\u8981\u6c42\uff1b\u5728\u82b1\u65f6\u95f4\u4ed4\u7ec6\u7814\u7a76\u5177\u5907\u521b\u9020\u6027\u95ee\u9898\u65f6\uff0c\u8fd8\u8981\u8003\u8651\u8bc9\u8bbc\u7684\u53ef\u80fd\u6027\u3002<\/p>\n\n\n\n<p>\u867d\u7136\u4e0d\u786e\u5b9a\u6743\u5229\u4eba\u5c06\u6765\u662f\u5426\u4f1a\u9047\u5230\u9700\u8981\u7ef4\u6743\u7684\u60c5\u51b5\uff0c\u4f46\u4f5c\u4e3a\u4ee3\u7406\u4eba\uff0c\u5c3d\u804c\u5c3d\u8d23\u662f\u8fd9\u9879\u5de5\u4f5c\u7684\u672c\u5206\uff0c\u4e0d\u80fd\u8ba9\u4e13\u5229\u6743\u4eba\u6743\u76ca\u53d7\u5230\u4fb5\u5bb3\u65f6\u624d\u53d1\u73b0\u4e13\u5229\u6709\u6f0f\u6d1e\uff0c\u65e9\u5df2\u4e3a\u65f6\u5df2\u665a\u3002<\/p>\n\n\n\n<p>\u5982\u8bfb\u8005\u670b\u53cb\u6709\u5176\u4ed6\u77e5\u8bc6\u4ea7\u6743\u76f8\u5173\u95ee\u9898\uff0c\u53ef\u5728\u516c\u4f17\u53f7\u540e\u53f0\u76f4\u63a5\u53d1\u6d88\u606f\u63d0\u95ee\uff0c\u6211\u4eec\u5c3d\u91cf\u4ee5\u6587\u7ae0\u5f62\u5f0f\u4e13\u9898\u89e3\u7b54\u3002\u611f\u8c22\u5927\u5bb6\u7684\u652f\u6301\u548c\u539a\u7231\uff01<\/p>\n\n\n\n<p>\u539f\u6587\u94fe\u63a5\uff1a<a
