After winning the bid, Tianyi Company purchased infringing products from Kangsheng Company, and Kangsheng Company purchased infringing products from Hongding Company. The infringing products were produced by Hongding Company according to Kangsheng Company&#8217;s custom-made requirements. The plaintiff Qisheng Company in this case is the patentee of the utility model patent ZL201521011294.4 &#8220;Bed Frame Buckle Structure&#8221;. Qisheng Company filed a patent infringement lawsuit against Xinyang Agriculture and Forestry University, Tianyi Company, Kangsheng Company, and Hongding Company as defendants(non-settling patent infringers). <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u4e00\u5ba1\u8bc9\u8bbc\u8fc7\u7a0b\u4e2d\uff0c\u5929\u4e00\u516c\u53f8\u4e0e\u4e13\u5229\u6743\u4eba\u68cb\u80dc\u516c\u53f8\u8fbe\u6210\u548c\u89e3\uff0c\u8d54\u507f\u68cb\u80dc\u516c\u53f89\u4e07\u5143\uff0c\u4e13\u5229\u6743\u4eba\u68cb\u80dc\u516c\u53f8\u64a4\u56de\u4e86\u5bf9\u5929\u4e00\u516c\u53f8\u7684\u8bc9\u8bbc\u3002<\/mark><\/p>\n\n<p>In the first instance, the court of first instance did not support the plaintiff Qisheng Company&#8217;s request for Kangsheng Company and XYAFU to compensate for losses and for XYAFU to stop using. These two requests are not the focus of this article, and the reasons will not be elaborated. <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u5173\u4e8e\u8d54\u507f\u635f\u5931\u7684\u6570\u989d<\/mark>, since Qisheng Company did not provide evidence to prove the 200,000 yuan infringement compensation, the court of first instance comprehensively considered the type of patent rights involved, the original defendant&#8217;s business scale, the nature and circumstances of the infringement, the price of the products involved, and the reasonable expenses incurred by Qisheng Company for rights protection, <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u786e\u5b9a\u9e3f\u9f0e\u516c\u53f8\u8d54\u507f\u68cb\u80dc\u516c\u53f8\u7ecf\u6d4e\u635f\u593110\u4e07\u5143\u3002<\/mark>\u9e3f\u9f0e\u516c\u53f8\u4e0d\u670d\u4e00\u5ba1\u6cd5\u9662\u7684\u5224\u51b3\uff0c\u63d0\u8d77\u4e0a\u8bc9\u3002<\/p>\n\n<p><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u4e8c\u5ba1\u6cd5\u9662\u6700\u9ad8\u9662\u6539\u5224\u9e3f\u9f0e\u516c\u53f8\u4e0e\u5eb7\u80dc\u516c\u53f8\u5171\u540c\u8fde\u5e26\u8d54\u507f\u4e13\u5229\u6743\u4eba\u7ecf\u6d4e\u635f\u59316\u4e07\u5143\u3002<\/mark> \u6700\u9ad8\u9662\u8ba4\u4e3a\uff0c <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u5173\u4e8e\u672c\u6848\u7684\u6c11\u4e8b\u8d23\u4efb\u627f\u62c5\uff0c\u8fd8\u9700\u8003\u8651\u68cb\u80dc\u516c\u53f8\u5728\u539f\u5ba1\u671f\u95f4\u64a4\u56de\u5bf9\u5929\u4e00\u516c\u53f8\u7684\u8d77\u8bc9\uff0c\u4ec5\u5bf9\u540c\u4e00\u4fb5\u6743\u4e8b\u5b9e\u4e2d\u7684\u90e8\u5206\u4fb5\u6743\u88ab\u544a\u63d0\u8d77\u8bc9\u8bbc\u7684\u60c5\u51b5\u3002<\/mark>\u672c\u6848\u4e2d\uff0c\u68cb\u80dc\u516c\u53f8\u672a\u4e3e\u8bc1\u8bc1\u660e\u5176\u56e0\u88ab\u4fb5\u6743\u6240\u53d7\u5230\u7684\u5b9e\u9645\u635f\u5931\uff0c\u6216\u5eb7\u80dc\u516c\u53f8\u53ca\u9e3f\u9f0e\u516c\u53f8\u56e0\u4fb5\u6743\u6240\u83b7\u5f97\u7684\u5229\u76ca\uff0c\u6839\u636e\u4e13\u5229\u6743\u7684\u6027\u8d28\u3001\u4fb5\u6743\u884c\u4e3a\u7684\u6027\u8d28\u3001\u68cb\u80dc\u516c\u53f8\u7684\u7ef4\u6743\u5408\u7406\u652f\u51fa\uff0c\u5e76\u8003\u8651\u6d89\u6848\u88ab\u8bc9\u4fb5\u6743\u4ea7\u54c1\u7684\u9500\u552e\u91d1\u989d\u3001\u6d89\u6848\u4e13\u5229\u5e8a\u5361\u6263\u7ed3\u6784\u5bf9\u88ab\u8bc9\u4fb5\u6743\u4ea7\u54c1\u7684\u5229\u6da6\u8d21\u732e\u7387\u3001\u68cb\u80dc\u516c\u53f8\u7684\u8bc9\u8bf7\u7b49\u56e0\u7d20\uff0c\u6700\u9ad8\u9662\u914c\u5b9a\u68cb\u80dc\u516c\u53f8\u56e0\u672c\u6848\u4fb5\u6743\u884c\u4e3a\u800c\u5e94\u83b7\u8d5415\u4e07\u5143\u3002\u68cb\u80dc\u516c\u53f8\u56e0\u672c\u6848\u4fb5\u6743\u4e8b\u5b9e\u5df2\u4ece\u5929\u4e00\u516c\u53f8\u5904\u83b7\u5f979\u4e07\u5143\u8d54\u507f\uff0c\u5e94\u5f53\u5728\u68cb\u80dc\u516c\u53f8\u5e94\u83b7\u8d54\u507f\u7684\u6570\u989d\u5185\u4e88\u4ee5\u6263\u9664\uff0c\u6545 <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #fe0000;\">\u5eb7\u80dc\u516c\u53f8<\/mark> \uff08\u4e8c\u5ba1\u8ba4\u4e3a\u5eb7\u80dc\u516c\u53f8\u4e0e\u9e3f\u9f0e\u516c\u53f8\u4e4b\u95f4\u6784\u6210\u59d4\u6258\u52a0\u5de5\u5173\u7cfb\uff0c\u975e\u672c\u6587\u8ba8\u8bba\u91cd\u70b9\uff0c\u53ef\u53c2\u8003 <a title=\"\" href=\"https:\/\/bulu-ip.com\/en\/patent-infringement-in-bidding-is-the-bid-organizer-liable\/\" target=\"_blank\" rel=\"noopener\">\u4e13\u5229\u4fb5\u6743\u6848\u4f8b\u2223\u62db\u6295\u6807\u3001\u59d4\u6258\u52a0\u5de5\u4e2d\u7684\u5171\u540c\u4fb5\u6743\u95ee\u9898\uff1a\u4e2d\u6807\u4eba\u5b9e\u65bd\u4e86\u4ed6\u4eba\u4e13\u5229\uff0c\u62db\u6807\u65b9\u7b97\u4e0d\u7b97\u4fb5\u6743<\/a>\u4e0e <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u9e3f\u9f0e\u516c\u53f8<\/mark> \u5728\u5269\u4f596\u4e07\u5143\u7684\u8d54\u507f\u91d1\u989d\u5185\u627f\u62c5\u8fde\u5e26\u8d54\u507f\u8d23\u4efb\u3002<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">Referee&#8217;s opinion<\/mark><\/h2>\n\n<p>\u5728\u4e13\u5229\u4fb5\u6743\u8bc9\u8bbc\u4e2d\uff0c\u88ab\u8bc9\u4fb5\u6743\u4ea7\u54c1\u7684\u5236\u9020\u8005\u5e94\u5f53\u5bf9\u4fb5\u6743\u540e\u679c\u627f\u62c5\u5168\u90e8\u8d54\u507f\u8d23\u4efb\u3002\u9488\u5bf9\u540c\u4e00\u8bc9\u8bbc\u6807\u7684\uff0c\u5f53\u591a\u4e3b\u4f53\u5747\u5b9e\u65bd\u4e86\u5236\u9020\u88ab\u8bc9\u4fb5\u6743\u4ea7\u54c1\u7684\u884c\u4e3a\u65f6\uff0c\u5404\u4fb5\u6743\u4e3b\u4f53\u5e94\u5bf9\u6743\u5229\u4eba\u627f\u62c5\u8fde\u5e26\u8d54\u507f\u8d23\u4efb\u3002\u6743\u5229\u4eba\u53ef\u4ee5\u9009\u62e9\u5411\u5168\u90e8\u6216\u90e8\u5206\u4fb5\u6743\u4e3b\u4f53\u4e3b\u5f20\u8d54\u507f\uff0c\u5404\u4fb5\u6743\u4e3b\u4f53\u5747\u6709\u4e49\u52a1\u5bf9\u6743\u5229\u4eba\u627f\u62c5\u5168\u90e8\u8d54\u507f\u8d23\u4efb\u3002\u4f46\u662f\uff0c\u7279\u5b9a\u6848\u4ef6\u4e2d\uff0c <span style=\"color: #ff0000;\">\u65e0\u8bba\u5982\u4f55\u8ba1\u7b97\u8d54\u507f\u6570\u989d\uff0c\u6743\u5229\u4eba\u56e0\u540c\u4e00\u8bc9\u8bbc\u6807\u7684\u5e94\u5f53\u83b7\u5f97\u7684\u8d54\u507f\u6570\u989d\u662f\u786e\u5b9a\u7684\u3002\u5982\u6743\u5229\u4eba\u56e0\u4e0e\u90e8\u5206\u4fb5\u6743\u4e3b\u4f53\u8fbe\u6210\u548c\u89e3\u7b49\u539f\u56e0\u5df2\u83b7\u5f97\u90e8\u5206\u8d54\u507f\uff0c\u4e3a\u907f\u514d\u6743\u5229\u4eba\u53cc\u91cd\u83b7\u5229\uff0c\u5176\u5df2\u83b7\u8d54\u507f\u7684\u91d1\u989d\u5e94\u5f53\u4e88\u4ee5\u6263\u51cf\uff0c\u5373\uff0c\u5176\u4f59\u88ab\u8bc9\u4fb5\u6743\u4e3b\u4f53\u4ec5\u9700\u5bf9\u6263\u51cf\u4e4b\u540e\u7684\u91d1\u989d\u627f\u62c5\u8fde\u5e26\u8d54\u507f\u8d23\u4efb\u3002<\/span> \u672c\u6848\u4e13\u5229\u6743\u4eba\u56e0\u4e0e\u5929\u4e00\u516c\u53f8\u548c\u89e3\u5df2\u7ecf\u83b7\u8d549\u4e07\u5143\uff0c\u6545\u5176\u4f59\u4fb5\u6743\u4eba\u7684\u8d54\u507f\u6570\u989d\u5e94\u51cf\u53bb\u5df2\u7ecf\u83b7\u8d54\u7684\u90e8\u5206\u3002<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u5c0f\u7ed3<\/mark><\/h2>\n\n<p>This case mainly discusses the legal issue of how non-settling patent infringers? should bear the liability for compensation after some infringers reach a settlement with the patent owner in a joint infringement case. By analyzing the court&#8217;s judgment, we can draw the following insights:<\/p>\n\n<p><strong>\u5171\u540c\u4fb5\u6743\u7684\u8fde\u5e26\u8d23\u4efb\u539f\u5219\u3002<\/strong> \u5728\u4e13\u5229\u4fb5\u6743\u6848\u4ef6\u4e2d\uff0c\u5982\u679c\u591a\u4e2a\u4e3b\u4f53\u5171\u540c\u53c2\u4e0e\u4e86\u5236\u9020\u6216\u9500\u552e\u4fb5\u6743\u4ea7\u54c1\uff0c\u4ed6\u4eec\u9700\u8981\u5bf9\u4e13\u5229\u6743\u4eba\u7684\u635f\u5931\u627f\u62c5\u8fde\u5e26\u8d23\u4efb\u3002\u5373\u4fbf\u90e8\u5206\u4fb5\u6743\u4eba\u5df2\u548c\u89e3\uff0c\u5176\u4ed6\u4fb5\u6743\u4eba\u4ecd\u9700\u627f\u62c5\u76f8\u5e94\u7684\u8d54\u507f\u4e49\u52a1\u3002<\/p>\n\n<p><strong>\u8d54\u507f\u91d1\u989d\u7684\u6263\u51cf\u673a\u5236\u3002 <\/strong>\u4e3a\u4e86\u9632\u6b62\u6743\u5229\u4eba\u56e0\u548c\u89e3\u83b7\u5f97\u53cc\u91cd\u8d54\u507f\uff0c\u6cd5\u9662\u5728\u786e\u5b9a\u5176\u4f59\u4fb5\u6743\u4eba\u7684\u8d54\u507f\u91d1\u989d\u65f6\uff0c\u4f1a\u5c06\u548c\u89e3\u4e2d\u5df2\u83b7\u5f97\u7684\u8d54\u507f\u91d1\u989d\u6263\u9664\u3002\u8fd9\u6837\u786e\u4fdd\u4e86\u4e13\u5229\u6743\u4eba\u53ea\u83b7\u5f97\u4e00\u6b21\u6027\u5408\u7406\u7684\u8d54\u507f\uff0c\u65e2\u4fdd\u62a4\u4e86\u4e13\u5229\u6743\u4eba\u7684\u6743\u76ca\uff0c\u4e5f\u907f\u514d\u4e86\u5bf9\u4fb5\u6743\u4eba\u8fc7\u5ea6\u60e9\u7f5a\u3002<\/p>\n<p \u6848\u4ef6\u4e2d\uff0c\u4e13\u5229\u6743\u4eba\u672a\u80fd\u63d0\u4f9b\u5145\u8db3\u7684\u8bc1\u636e\u8bc1\u660e\u7279\u5b9a\u4fb5\u6743\u4eba\u7684\u8fc7\u9519\uff0c\u5bfc\u81f4\u90e8\u5206\u8bc9\u8bbc\u8bf7\u6c42\u672a\u83b7\u652f\u6301\u3002\u8fd9\u8868\u660e\uff0c\u5728\u4e13\u5229\u4fb5\u6743\u8bc9\u8bbc\u4e2d\uff0c\u8bc1\u636e\u94fe\u7684\u5b8c\u6574\u6027\u5bf9\u4e8e\u4e89\u53d6\u5408\u7406\u7684\u8d54\u507f\u81f3\u5173\u91cd\u8981\u3002<\/p>\n<p><\/p>\n<p>\u603b\u4f53\u800c\u8a00\uff0c\u8be5\u6848\u4f8b\u63d0\u9192\u6211\u4eec\uff0c\u5728\u4e13\u5229\u4fb5\u6743\u8bc9\u8bbc\u4e2d\uff0c\u4e0d\u4ec5\u9700\u8981\u660e\u786e\u4fb5\u6743\u4e8b\u5b9e\uff0c\u8fd8\u9700\u5145\u5206\u51c6\u5907\u76f8\u5173\u8bc1\u636e\uff0c\u5e76\u5bf9\u548c\u89e3\u53ca\u8d54\u507f\u91d1\u989d\u8fdb\u884c\u5408\u7406\u5206\u914d\u548c\u6263\u51cf\uff0c\u786e\u4fdd\u6cd5\u5f8b\u7684\u516c\u5e73\u4e0e\u516c\u6b63\u3002<\/p>\n<p><\/p>\n<p>\u539f\u6587\u94fe\u63a5\uff1a<a
