applied for an invention patent for the same technical solution on the same day, but the latter was rejected. The patentee sued the defendant for infringement of their patent rights using a utility model patent. The first instance court ruled that the defendant should compensate the patentee 60000 yuan. The defendant was dissatisfied and appealed to the SPC, which revoked the first instance court&#8217;s judgment after hearing the case. So, if the same patent holder applies for the same applicant on the same day and faces invention rejection, is it certain that the utility model patent cannot be protected?<\/p>\n\n<p>\u4e13\u5229\u6743\u5408\u6cd5\u6709\u6548\u3001\u4e14\u6743\u5229\u76f8\u5bf9\u7a33\u5b9a\u662f\u5176\u83b7\u5f97\u4fdd\u62a4\u7684\u524d\u63d0\u3002\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u88ab\u9a73\u56de\uff0c\u540c\u4eba\u540c\u65e5\u540c\u65b9\u6848\u7684\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u6743\u662f\u5426\u7a33\u5b9a\uff0c\u9700\u8981\u4ece\u53d1\u660e\u4e13\u5229\u88ab\u9a73\u56de\u7684\u5177\u4f53\u60c5\u5f62\u5177\u4f53\u5206\u6790\u3002<\/p>\n\n<p>\u4e00\u822c\u6765\u8bf4\uff0c\u5982\u679c\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u56e0\u7f3a\u4e4f\u65b0\u9896\u6027\u6216\u662f\u672a\u91c7\u7528\u5bf9\u6bd4\u6587\u4ef6\u5c31\u88ab\u9a73\u56de\u7684\uff0c\u901a\u5e38\u76f8\u540c\u6280\u672f\u65b9\u6848\u7684\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u53ef\u4ee5\u88ab\u8ba4\u5b9a\u4e3a\u6743\u5229\u4e0d\u7a33\u5b9a\uff0c\u4e0d\u80fd\u83b7\u5f97\u4fdd\u62a4\u3002<\/p>\n\n<p>\u4f46\u662f\uff0c\u5982\u679c\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u7cfb\u56e0\u88ab\u8ba4\u5b9a\u4e3a\u4e0d\u5177\u5907\u521b\u9020\u6027\u800c\u9a73\u56de\uff0c\u5219\u8fd8\u5e94\u8fdb\u4e00\u6b65\u6839\u636e\u5177\u4f53\u60c5\u51b5\u5177\u4f53\u5206\u6790\u3002\u56e0\u4e3a\u6211\u56fd\u4e13\u5229\u6cd5\u89c4\u5b9a\u7684\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u548c\u53d1\u660e\u4e13\u5229\u7684\u521b\u9020\u6027\u8981\u6c42\u662f\u4e0d\u540c\u7684\uff0c\u56e0\u6b64\u8981\u6839\u636e\u5177\u4f53\u60c5\u51b5\u505a\u51fa\u4e0d\u540c\u7684\u5904\u7406\u3002<\/p>\n\n<p>\u4e0a\u8ff0\u6848\u4ef6\u4e2d\uff0c\u56fd\u5bb6\u77e5\u8bc6\u4ea7\u6743\u5c40\u5728\u5bf9\u540c\u4eba\u540c\u65e5\u540c\u65b9\u6848\u7684\u53d1\u660e\u4e13\u5229\u7684\u5b9e\u8d28\u5ba1\u67e5\u8fc7\u7a0b\u4e2d\uff0c\u662f\u4ee5\u539f\u59cb\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u7684\u6743\u5229\u8981\u6c421\u30014-7\u4e0d\u5177\u5907\u65b0\u9896\u6027\uff0c\u6743\u5229\u8981\u6c422\u30013\u4e0d\u5177\u5907\u521b\u9020\u6027\u4e3a\u7531\uff0c\u9a73\u56de\u4e86\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u3002\u5e76\u4e14\u8bc4\u4ef7\u6743\u5229\u8981\u6c422\u30013\u4e0d\u5177\u5907\u521b\u9020\u6027\u7684\u5bf9\u6bd4\u6587\u4ef6\u662f\u6743\u5229\u8981\u6c421\u4e0d\u5177\u5907\u65b0\u9896\u6027\u7684\u6587\u4ef6\uff0c\u7533\u8bf7\u4eba\u5728\u7b54\u590d\u7b2c\u4e00\u6b21\u5ba1\u67e5\u610f\u89c1\u65f6\u5bf9\u539f\u59cb\u6743\u5229\u8981\u6c421-4\u8fdb\u884c\u4e86\u5408\u5e76\uff0c\u8868\u660e\u7533\u8bf7\u4eba\u5df2\u8ba4\u53ef\u4e86\u7b2c\u4e00\u6b21\u5ba1\u67e5\u610f\u89c1\uff0c\u8fd9\u79cd\u5408\u5e76\u540e\u7684\u72ec\u7acb\u6743\u5229\u8981\u6c42\u4ecd\u4e0d\u5177\u5907\u521b\u9020\u6027\u3002\u56e0\u6b64\uff0c\u4e0a\u8ff0\u6848\u4ef6\u7684\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u662f\u7528\u4e00\u7bc7\u5bf9\u6bd4\u6587\u4ef6\uff0c\u9a73\u56de\u4e86\u5168\u90e8\u6743\u5229\u8981\u6c42\u3002<\/p>\n\n<p>\u7531\u6b64\u770b\u6765\uff0c\u5bf9\u4e8e\u540c\u4eba\u540c\u65e5\u540c\u65b9\u6848\u7533\u8bf7\u7684\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u548c\u53d1\u660e\u4e13\u5229\uff0c\u5982\u679c\u53d1\u660e\u4e13\u5229\u7533\u8bf7\u56e0\u4e0d\u5177\u5907\u65b0\u9896\u6027\u6216\u8005\u57fa\u4e8e\u76f8\u540c\u6280\u672f\u9886\u57df\u7684\u4e00\u7bc7\u5bf9\u6bd4\u6587\u4ef6\u5c31\u88ab\u8ba4\u5b9a\u4e0d\u5177\u5907\u521b\u9020\u6027\uff0c\u800c\u672a\u88ab\u6388\u6743\u7684\uff0c\u5176\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u4e5f\u4e0d\u80fd\u7528\u4e8e\u4e13\u5229\u4fdd\u62a4\u3002\u56e0\u6b64\uff0c\u6700\u9ad8\u6cd5\u64a4\u9500\u4e86\u4e00\u5ba1\u6cd5\u9662\u7684\u5224\u51b3\u3002<\/p>\n\n<p>\u4f46\u662f\uff0c\u5982\u679c\u540c\u4eba\u540c\u65e5\u540c\u65b9\u6848\u7684\u53d1\u660e\u4e13\u5229\u88ab\u8ba4\u5b9a\u4e3a\u4e0d\u5177\u5907\u521b\u9020\u6027\u800c\u9a73\u56de\u65f6\u4f7f\u7528\u7684\u6761\u4ef6\uff0c\u660e\u663e\u8d85\u8d8a\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u7684\u521b\u9020\u6027\u5ba1\u67e5\u6807\u51c6\uff0c\u4f8b\u5982\u53d1\u660e\u4e13\u5229\u9a73\u56de\u65f6\u4f7f\u7528\u7684\u5bf9\u6bd4\u6587\u4ef6\u4e0e\u4e13\u5229\u7533\u8bf7\u5c5e\u4e8e\u4e0d\u540c\u7684\u6280\u672f\u9886\u57df\uff0c\u6216\u8005\u4f7f\u7528\u4e86\u591a\u7bc7\u5bf9\u6bd4\u6587\u4ef6\u7b49\uff0c\u624d\u5c06\u53d1\u660e\u4e13\u5229\u9a73\u56de\uff0c\u6b64\u65f6\u5e94\u614e\u91cd\u8003\u8651\u540c\u4eba\u540c\u65e5\u540c\u65b9\u6848\u7684\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u7684\u7a33\u5b9a\u6027\u548c\u5408\u6cd5\u6027\uff0c\u4e0d\u5e94\u8349\u7387\u8ba4\u5b9a\u4e3a\u53d1\u660e\u4e13\u5229\u88ab\u9a73\u56de\uff0c\u76f8\u540c\u6280\u672f\u65b9\u6848\u7684\u5b9e\u7528\u65b0\u578b\u4e13\u5229\u4e5f\u662f\u65e0\u6548\u7684\u3002<\/p>\n\n<p>\u00a0<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div
