color: #705b90;\">\u6848\u4f8b\u4e00\uff1a\u5de5\u7a0b\u65bd\u5de5\u4e13\u5229\u4fb5\u6743\u6848\uff08\u62db\u6295\u6807\uff09<\/mark><\/h2>\n\n<p>\u7532\uff08\u539f\u544a\u3001\u4e0a\u8bc9\u4eba\uff09\u662f\uff1a\u67d0\u4e13\u5229\u6301\u6709\u4eba<\/p>\n\n<p>\u4e59\uff08\u88ab\u544a\u3001\u4e0a\u8bc9\u4eba\uff09\u662f\uff1a\u67d0\u571f\u5730\u6cbb\u7406\u5de5\u7a0b\u7684\u65bd\u5de5\u65b9\uff08\u4e2d\u6807\u65b9\uff09<\/p>\n\n<p>\u4e19\uff08\u88ab\u544a\u3001\u88ab\u4e0a\u8bc9\u4eba\uff09\u662f\uff1a\u5de5\u7a0b\u7684\u7ba1\u7406\u673a\u5173\uff08\u62db\u6807\u65b9\uff09<\/p>\n\n<p>\u4e01\uff08\u88ab\u544a\u3001\u88ab\u4e0a\u8bc9\u4eba\uff09\u662f\uff1a\u5de5\u7a0b\u62db\u6807\u6587\u4ef6\u7684\u5236\u4f5c\u65b9\uff08\u62db\u6807\u516c\u53f8\uff09<\/p>\n\n<p>The case is that B used A&#8217;s patented technology in the project, and A requested the first instance court: B should compensate for the economic losses, and C and D should bear joint and several liability.<\/p>\n\n<p>The court of first instance held that the scheme used by B (the successful bidder) fell within the scope of protection of the patent right involved in the case, and its construction behavior constituted infringement; D was a bidding company, and its behavior of preparing bidding documents and organizing bidding activities according to the scheme provided by C (the tenderer) could not be identified as &#8220;implementation&#8221; of infringement as stipulated in the Patent Law, so D (the bidding company) did not infringe; C (the tenderer) was a state administrative agency, and its organization of the project was a public welfare project, which was the performance of the duties of the administrative agency, not a production and operation activity. C (the tenderer)&#8217;s request to use the patented scheme was not an infringement and did not constitute infringement. Therefore, the court only ordered B (the successful bidder) to compensate A for 120,000 yuan, and rejected A&#8217;s other claims.<\/p>\n\n<p>\u7532\u4e59\u5747\u4e0d\u670d\uff0c\u5206\u522b\u5411\u6700\u9ad8\u4eba\u6c11\u6cd5\u9662\u63d0\u8d77\u4e0a\u8bc9\uff0c\u4e59\uff08\u4e2d\u6807\u65b9\uff09\u8ba4\u4e3a\u5176\u5b9e\u65bd\u7684\u65b9\u6848\u867d\u7136\u4fb5\u6743\u4f46\u6709 <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u5408\u6cd5<\/mark>\u6765\u6e90\uff0c\u4e19\uff08\u62db\u6807\u65b9\uff09\u548c\u4e01\uff08\u62db\u6807\u516c\u53f8\uff09\u5e94\u8be5\u627f\u62c5\u4fb5\u6743\u8d23\u4efb\u3002\u4e8c\u5ba1\u4e2d\u7532\u653e\u5f03\u4e86\u5bf9\u62db\u6295\u6807\u516c\u53f8\u4e01\uff08\u62db\u6807\u516c\u53f8\uff09\u7684\u8bc9\u8bbc\u8bf7\u6c42\u3002<\/p>\n\n<p>\u6700\u9ad8\u6cd5\u8ba4\u4e3a\uff1a <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">although the person who finally implemented the behavior was B (the successful bidder), C (the tenderer) had clear requirements for the construction method in the engineering bidding documents and the engineering construction contract, and the construction method fell within the protection scope of the patent right involved in the case. In essence, it was C (the tenderer)&#8217;s behavior that determined the implementation of the final construction technical plan. Therefore, C (the tenderer)&#8217;s behavior used the patent method involved in the case.<\/mark>\u00a0\u6b64\u5916\uff0c\u4ece\u4e19\uff08\u62db\u6807\u65b9\uff09\u4e0e\u4e59\uff08\u4e2d\u6807\u65b9\uff09\u4e4b\u95f4\u5c31\u6d89\u6848\u5de5\u7a0b\u8fdb\u884c\u62db\u6807\u3001\u6295\u6807\u3001\u4e2d\u6807\u5e76\u7b7e\u8ba2\u5de5\u7a0b\u65bd\u5de5\u5408\u540c\u7684\u8fc7\u7a0b\u6765\u770b\uff0c\u5e94\u5f53\u8ba4\u5b9a\u53cc\u65b9\u4e4b\u95f4\u5b58\u5728\u5171\u540c\u4f7f\u7528\u6d89\u6848\u4e13\u5229\u65b9\u6cd5\u7684\u610f\u601d\uff0c\u6545\u5e94\u5f53\u8ba4\u5b9a\u53cc\u65b9\u5171\u540c\u5b9e\u65bd\u4e86\u4fb5\u6743\u884c\u4e3a\u3002\u6700\u9ad8\u6cd5\u7684\u6700\u7ec8\u5224\u51b3\u7ed3\u679c\u662f\u4e59\uff08\u4e2d\u6807\u65b9\uff09\u3001\u4e19\uff08\u62db\u6807\u65b9\uff09\u6784\u6210\u5171\u540c\u4fb5\u6743\uff0c\u5171\u540c\u8d54\u507f\u753245\u4e07\u5143\u3002<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u6848\u4f8b\u4e8c\uff1a\u5e8a\u67b6\u5361\u53e3\u4e13\u5229\u4fb5\u6743\u6848\uff08\u59d4\u6258\u52a0\u5de5\uff09<\/mark><\/h2>\n\n<p>In Case 2, the patent owner&#8217;s patent is a bed frame clip. Distributor B commissioned manufacturer A to process these patent infringement products according to the technical solutions provided by B. During the trial, the court of first instance held that the alleged infringing products fell within the scope of protection of the patent right involved in the case of the patent owner; A was the manufacturer of the alleged infringing products and sold them to B, and finally sold them to D through B and C. The patent owner did not provide evidence to prove that B and D &#8220;knew&#8221; that the products provided by A were patent infringement products, so the patent owner&#8217;s request for compensation for losses was not supported. D used the alleged infringing bed frame buckle in student dormitories, and stopping its use might cause unnecessary waste, so it was not necessary to stop using it and did not need to bear compensation liability. Therefore, the court of first instance ruled that A and B should stop infringing, A should compensate the patent owner for economic losses of 100,000 yuan, and rejected the patent owner&#8217;s other claims.<\/p>\n\n<p>The SPC held in the second instance that: B&#8217;s defense of legitimate source and only sales behavior was wrong. <mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #ff0000;\">\u5728\u59d4\u6258\u52a0\u5de5\u4e13\u5229\u4ea7\u54c1\u7684\u60c5\u51b5\u4e0b\uff0c\u5982\u679c\u59d4\u6258\u65b9\u8981\u6c42\u52a0\u5de5\u65b9\u6839\u636e\u5176\u63d0\u4f9b\u7684\u6280\u672f\u65b9\u6848\u5236\u9020\u4e13\u5229\u4ea7\u54c1\uff0c\u5219\u53ef\u4ee5\u8ba4\u5b9a\u662f\u53cc\u65b9\u5171\u540c\u5b9e\u65bd\u4e86\u5236\u9020\u4e13\u5229\u4ea7\u54c1\u7684\u884c\u4e3a\u3002<\/mark>\u00a0The product of the alleged patent infringement is the manufacturing technical solution provided by B to A. A manufactured the product that falls within the scope of patent protection according to B&#8217;s requirements. The relationship between B and A is not a sales contract relationship, but a commissioned processing contract relationship. The two jointly implemented the behavior of manufacturing and selling the alleged infringing products. They should bear joint and several liability for all infringement damages based on the same infringement damage facts and should jointly and severally compensate.<\/p>\n\n<p>\u539f\u6587\u94fe\u63a5\uff1a<a title=\"\" href=\"https:\/\/mp.weixin.qq.com\/s\/zrpXHAGcx0yWUaKcTsNV0w\" target=\"_blank\"
