(SPC) can give us some inspiration, and companies should pay attention when cooperating with others.<\/p>\n\n<p>The &#8220;inventor&#8221; in this case is a university teacher and the contact person in the &#8220;Technology Development (Commission) Contract&#8221; signed between the university and the &#8220;Plaintiff Company&#8221;. The inventor also signed a &#8220;Consulting Service Contract&#8221; with the Plaintiff Company. From May 2011 to June 2012 (during the dispute), the inventor and the Plaintiff Company had email exchanges discussing the content of the patent technology solution. Afterwards, the inventor himself applied for a patent for the technology containing the relevant invention points in the emails during the dispute period, and then changed the patent applicant to the &#8220;Defendant Company&#8221;. Therefore, the Plaintiff Company filed a lawsuit, requesting that the patent in question be awarded to the Plaintiff Company. The case was heard by two courts,\u00a0<strong><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">and the Plaintiff Company&#8217;s lawsuit was ultimately rejected.<\/mark><\/strong><\/p>\n\n<p><strong><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u6b64\u65f6\u6709\u4eba\u4f1a\u95ee\uff0c\u660e\u660e\u662f\u539f\u544a\u516c\u53f8\u51fa\u94b1\u59d4\u6258\u7684\u6280\u672f\u5f00\u53d1\uff0c\u6700\u540e\u4e3a\u4f55\u5224\u51b3\u539f\u544a\u8d25\u8bc9\u5462\uff1f<\/mark><\/strong><\/p>\n\n<p>\u5224\u51b3\u4e3b\u8981\u4f9d\u636e\u53cc\u65b9\u7b7e\u8ba2\u7684\u5408\u540c\u3002\u53d1\u660e\u4eba\u548c\u539f\u544a\u516c\u53f8\u4e4b\u95f4\u5171\u5b58\u5728\u4e24\u4efd\u5408\u540c\uff0c\u800c <strong><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u8fd9\u4e24\u4efd\u5408\u540c\u4e2d\uff0c\u65e2\u6ca1\u6709\u660e\u786e\u53d1\u660e\u4eba\u4e0e\u539f\u544a\u516c\u53f8\u4e4b\u95f4\u7684\u5de5\u4f5c\u5173\u7cfb\uff08\u5373\u6ca1\u6709\u8bc1\u636e\u8bc1\u660e\u53d1\u660e\u4eba\u4e0e\u539f\u544a\u516c\u53f8\u4e4b\u95f4\u7684\u5de5\u4f5c\u5173\u7cfb\u662f\u52b3\u52a8\u5173\u7cfb\u6216\u662f\u4e34\u65f6\u5de5\u4f5c\u5173\u7cfb\uff09\uff0c\u4e5f\u6ca1\u6709\u57fa\u4e8e\u8be5\u5de5\u4f5c\u5173\u7cfb\u5f62\u6210\u7684\u76f8\u5173\u6280\u672f\u6210\u679c\u7684\u5f52\u5c5e\u7684\u610f\u601d\u8868\u8fbe\u3002<\/mark><\/strong><\/p>\n\n<p>Although the plaintiff company paid the inventor a monthly salary and housing allowance, paid social security, reimbursed travel expenses, and listed the inventor as the new product development director and product manager, and there were weekly reports at work, etc. However, the SPC believed that the inventor&#8217;s identity as a university teacher had not changed; the above evidence was not sufficient to determine that there was a labor relationship or temporary working relationship between the inventor and the plaintiff company in the sense of &#8220;employment invention&#8221;, and could not be the legal and factual basis for the plaintiff company to claim that it was a work invention in this patent ownership dispute case.<\/p>\n\n<p>\u53d1\u660e\u4eba\u4e0e\u5355\u4f4d\u4e4b\u95f4\u5b58\u5728\u52b3\u52a8\u5173\u7cfb\u6216\u4e34\u65f6\u5de5\u4f5c\u5173\u7cfb\uff0c\u662f\u8ba4\u5b9a\u804c\u52a1\u53d1\u660e\u7684\u524d\u63d0\u3002\u52b3\u52a8\u5173\u7cfb\u6216\u4e34\u65f6\u5de5\u4f5c\u5173\u7cfb\u7684\u5224\u65ad\u6807\u51c6\u5728\u4e8e\u5355\u4f4d <strong><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u662f\u5426\u53d6\u5f97\u4e86\u5bf9\u53d1\u660e\u4eba\u7684\u52b3\u52a8\u652f\u914d\u6743\uff0c\u5305\u62ec\u5b8c\u6210\u53d1\u660e\u521b\u9020\u7684\u521b\u9020\u6027\u52b3\u52a8\u5728\u5185\u7684\u52b3\u52a8\u652f\u914d\u6743\u3002\u00a0<\/mark><\/strong>If there is only a general cooperative relationship between the unit and the inventor and the unit does not have the labor control rights over the inventor, the inventor&#8217;s invention does not constitute a work-related invention.<\/p>\n\n<p>According to the &#8220;Patent Law of the People&#8217;s Republic of China&#8221;, the patent (application) right in the process of cooperative or commissioned research and development shall be based on the contractual agreement. <strong><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u6ca1\u6709\u7ea6\u5b9a\u7684\uff0c\u5b8c\u6210\u53d1\u660e\u521b\u9020\u7684\u4eba\u53ef\u4ee5\u4f5c\u4e3a\u4e13\u5229\u7533\u8bf7\u4eba\u3002<\/mark><\/strong><\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">\u542f\u793a<\/mark><\/h2>\n\n<p>\u6b64\u6848\u4f8b\u8ba9\u6211\u4eec\u8b66\u9192\uff1a<\/p>\n\n<p>\u4e00\u3001\u7b7e\u8ba2\u5408\u540c\u65f6\uff0c\u4e00\u5b9a\u8981\u7ea6\u5b9a\u597d\u77e5\u8bc6\u4ea7\u6743\u7684\u5f52\u5c5e\uff0c\u5426\u5219\uff0c\u518d\u70ed\u7684\u5fc3\u80a0\uff0c\u4e5f\u4e0d\u80fd\u6539\u53d8\u6cd5\u5f8b\u7684\u89c4\u5b9a\uff0c\u9020\u6210\u82b1\u94b1\u53c8\u5403\u4e8f\u7684\u5c34\u5c2c\u5c40\u9762\u3002<\/p>\n\n<p>2. Enterprises and other market entities that want to engage in innovative research and development can refer to the contents of &#8220;<a title=\"\" href=\"http:\/\/c.gb688.cn\/bzgk\/gb\/showGb?type=online&amp;hcno=6C9E44962BB8DD0AEF329110DB456C14\" target=\"_blank\" rel=\"noopener\">\u300a\u4f01\u4e1a\u77e5\u8bc6\u4ea7\u6743\u7ba1\u7406\u89c4\u8303GB\/T29490\u300b\uff08\u56fd\u5bb6\u6807\u51c6\uff09<\/a>&#8221; and &#8220;<a title=\"\" href=\"https:\/\/www.iso.org\/obp\/ui\/en\/#iso:std:iso:56001:ed-1:v1:en\" target=\"_blank\" rel=\"noopener\">\u300a\u521b\u65b0\u7ba1\u7406\u4f53\u7cfbISO56001\u300b\uff08\u56fd\u9645\u6807\u51c6\uff09<\/a>&#8221; to independently improve internal management.<\/p>\n\n<p>\u539f\u6587\u94fe\u63a5\uff1a<a title=\"\" href=\"https:\/\/mp.weixin.qq.com\/s\/GISk8HycOv9nTshjEoLZWA\" target=\"_blank\" rel=\"noopener\">\u5408\u540c\u4e2d\u7684\u9690\u60a3\uff1a\u5982\u4f55\u907f\u514d\u59d4\u6258\u7814\u53d1\u4e13\u5229\u6743\u5c5e\u7ea0\u7eb7\uff0c\u53ca\u804c\u52a1\u53d1\u660e\u8ba4\u5b9a<\/a><\/p>\n\n<p>\u5173\u4e8e\u6211\u4eec\uff1a<a
