color: #705b90;\">1. \u5f15\u8a00<\/mark><\/h2>\n\n<p>\u7535\u5546\u76ee\u524d\u5df2\u7ecf\u6210\u4e3a\u4e3b\u6d41\u7684\u9500\u552e\u6a21\u5f0f\uff0c\u5728\u7535\u5b50\u5546\u52a1\u5e73\u53f0\u4e0a\u9500\u552e\u4ea7\u54c1\u7684\u77e5\u8bc6\u4ea7\u6743\u4fb5\u6743\u7ea0\u7eb7\u6848\u4ef6\u4e5f\u8d8a\u6765\u8d8a\u591a\u3002\u5728\u53d1\u751f\u4fb5\u6743\u7ea0\u7eb7\u65f6\uff0c\u77e5\u8bc6\u4ea7\u6743\u7684\u6743\u5229\u4eba\u4e3a\u4e86\u53ca\u65f6\u4e2d\u6b62\u635f\u5931\uff0c\u53ef\u4ee5\u5728\u6848\u4ef6\u6ca1\u6709\u6700\u540e\u7ed3\u679c\u7684\u60c5\u51b5\u4e0b\uff0c\u5373\u8981\u6c42\u7535\u5546\u5e73\u53f0\u5220\u9664\u88ab\u8bc9\u4fb5\u6743\u4ea7\u54c1\u7684\u94fe\u63a5\u3002\u4f46\u5982\u679c\u88ab\u8bc9\u4fb5\u6743\u4eba\u8ba4\u4e3a\u81ea\u5df1\u4e0d\u4fb5\u6743\u6216\u8005\u6743\u5229\u4eba\u7684\u77e5\u8bc6\u4ea7\u6743\uff08\u5982\u4e13\u5229\u6743\uff09\u4e0d\u7a33\u5b9a\u53ef\u80fd\u88ab\u65e0\u6548\uff0c\u88ab\u8bc9\u4fb5\u6743\u4eba\u53c8\u53ef\u4ee5\u53cd\u8fc7\u6765\u8bf7\u6c42\u7535\u5546\u5e73\u53f0\u4e0d\u65ad\u5f00\u94fe\u63a5\u6216\u6062\u590d\u94fe\u63a5\uff1b\u88ab\u8bc9\u4fb5\u6743\u4eba\u8fd9\u79cd\u8bf7\u6c42\u7ee7\u7eed\u94fe\u63a5\u800c\u9500\u552e\u7684\uff0c\u5e94\u8be5\u63d0\u4f9b\u62c5\u4fdd\uff0c\u6b64\u884c\u4e3a\u79f0\u4e3a\u53cd\u5411\u884c\u4e3a\u4fdd\u5168\u3002<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">2. \u6848\u4f8b\u4ecb\u7ecd<\/mark><\/h2>\n\n<h3 class=\"wp-block-heading\">2.1 \u6848\u4ef6\u80cc\u666f<\/h3>\n\n<p>(2020) The Supreme People&#8217;s Court of P.R.C. (SPC)&#8217;s Intellectual Property Court Civil Final Appeal No. 993 disclosed a case of reverse behavior preservation.<\/p>\n\n<p>In this case, the utility model patent owner of the &#8220;flat mop cleaning tool&#8221; claimed that the infringing products sold by the accused infringer (hereinafter referred to as the defendant) on Tmall infringed its patent rights, and requested the defendant to stop the infringement, and required Tmall to delete and disconnect the sales links involved and compensate for economic losses. The first instance court supported the patent owner&#8217;s request, and Tmall deleted the sales links involved.<\/p>\n\n<h3 class=\"wp-block-heading\">2.2 \u53cd\u5411\u884c\u4e3a\u4fdd\u5168\u7533\u8bf7<\/h3>\n\n<p>During the second instance, as &#8220;November 11\uff08major festivals for promotions on China&#8217;s e-commerce platforms\uff09&#8221; was approaching, the defendant filed an application for reverse behavior preservation with the Supreme Court, requesting the court to order Tmall to immediately restore the sales link involved in the case, and stated that if the link was not restored, the defendant would suffer irreparable losses during the &#8220;November 11&#8221; period; at this time, CNIPA also made a review decision on the request for invalidation of the patent involved, declaring that all the patent rights involved were invalid.<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">3. \u6700\u9ad8\u6cd5\u9662\u7684\u88c1\u5b9a<\/mark><\/h2>\n\n<p>\u9488\u5bf9\u88ab\u544a\u7684\u53cd\u5411\u884c\u4e3a\u4fdd\u5168\u7533\u8bf7\uff0c\u6700\u9ad8\u6cd5\u4e8e\u7b2c\u4e8c\u65e5\u4f5c\u51fa\u884c\u4e3a\u4fdd\u5168\u88c1\u5b9a\uff0c\u8d23\u4ee4\u5929\u732b\u7acb\u5373\u6062\u590d\u88ab\u544a\u7684\u88ab\u8bc9\u4fb5\u6743\u4ea7\u54c1\u9500\u552e\u94fe\u63a5\uff0c\u4f46\u51bb\u7ed3\u88ab\u544a\u652f\u4ed8\u5b9d\u8d26\u6237\u90e8\u5206\u6b3e\u9879\u5171\u8ba11560\u4e07\u5143\u4f5c\u4e3a\u62c5\u4fdd\u3002<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">4. \u88c1\u5b9a\u7406\u7531<\/mark><\/h2>\n\n<h3 class=\"wp-block-heading\">4.1 \u4e13\u5229\u6743\u7684\u4e0d\u786e\u5b9a\u6027<\/h3>\n\n<p>\u6700\u9ad8\u6cd5\u4e4b\u6240\u4ee5\u51bb\u7ed3\u88ab\u544a\u8d26\u53f7\u7684\u90e8\u5206\u6b3e\u9879\uff0c\u662f\u56e0\u4e3a\uff0c\u867d\u7136\u6d89\u6848\u4e13\u5229\u88ab\u56fd\u77e5\u5c40\u5ba3\u544a\u65e0\u6548\uff0c\u4f46\u4e13\u5229\u6743\u4eba\u53ef\u80fd\u63d0\u8d77\u884c\u653f\u8bc9\u8bbc\uff0c\u6d89\u6848\u4e13\u5229\u7684\u6709\u6548\u6027\u8fd8\u5904\u4e8e\u4e0d\u786e\u5b9a\u72b6\u6001\u3002<\/p>\n\n<h3 class=\"wp-block-heading\">4.2 \u5e02\u573a\u7ade\u4e89\u5f71\u54cd<\/h3>\n\n<p>\u5982\u679c\u4e0d\u6062\u590d\u88ab\u544a\u4ea7\u54c1\u7684\u94fe\u63a5\uff0c\u6709\u53ef\u80fd\u635f\u5bb3\u88ab\u544a\u7684\u5e02\u573a\u7ade\u4e89\u4f18\u52bf\u6216\u5546\u4e1a\u673a\u4f1a\uff0c\u5bfc\u81f4\u88ab\u544a\u5728\u53cc\u5341\u4e00\u671f\u95f4\u7684\u9500\u552e\u53d7\u5230\u4e25\u91cd\u5f71\u54cd\u3002<\/p>\n\n<h3 class=\"wp-block-heading\">4.3 \u4e13\u5229\u6743\u4eba\u7684\u635f\u5bb3<\/h3>\n\n<p>Restoring the link will not lead to the complete replacement of the patent owner&#8217;s product, and the damage to the patent owner is relatively small. Therefore, SPC ordered Tmall to immediately restore the defendant&#8217;s sales link for the alleged infringing products, but froze part of the defendant&#8217;s Alipay account and wait for the final result of the administrative lawsuit for patent invalidation.<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">5. \u6cd5\u5f8b\u4e49\u52a1\u548c\u5ba1\u67e5\u6807\u51c6<\/mark><\/h2>\n\n<p>In this case, the SPC believes that: when the e-commerce platform operator (Tmall) receives a notice from the intellectual property rights holder containing preliminary evidence of infringement, it has a legal obligation to take necessary measures such as deletion, blocking, disconnecting links, and terminating transactions and services. However, after taking the above-mentioned sales prohibition measures, if the links are not restored, the defendant&#8217;s legitimate interests will suffer irreparable damage. The defendant can apply to the SPC for reverse behavior preservation and require the e-commerce platform to take behavior preservation measures such as restoring links.<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">6. \u6cd5\u9662\u5ba1\u67e5\u8003\u8651\u56e0\u7d20<\/mark><\/h2>\n\n<p>During the court&#8217;s legal review, when determining whether to restore the link for reverse behavior preservation measures, the following factors should be mainly considered:<\/p>\n\n<p>\uff081\uff09\u6062\u590d\u8bf7\u6c42\u662f\u5426\u5177\u6709\u4e8b\u5b9e\u57fa\u7840\u548c\u6cd5\u5f8b\u4f9d\u636e\uff1b<\/p>\n\n<p>\uff082\uff09\u4e0d\u6062\u590d\u94fe\u63a5\u662f\u5426\u4f1a\u5bf9\u6062\u590d\u7533\u8bf7\u4eba\uff08\u88ab\u544a\uff09\u9020\u6210\u96be\u4ee5\u5f25\u8865\u7684\u635f\u5bb3\uff1b<\/p>\n\n<p>\uff083\uff09\u6062\u590d\u94fe\u63a5\u5bf9\u4e13\u5229\u6743\u4eba\u53ef\u80fd\u9020\u6210\u7684\u635f\u5bb3\u662f\u5426\u4f1a\u8d85\u8fc7\u4e0d\u6062\u590d\u94fe\u63a5\u5bf9\u88ab\u544a\u9020\u6210\u7684\u635f\u5bb3\uff1b<\/p>\n\n<p>\uff084\uff09\u6062\u590d\u94fe\u63a5\u662f\u5426\u4f1a\u635f\u5bb3\u793e\u4f1a\u516c\u5171\u5229\u76ca\uff1b<\/p>\n\n<p>\uff085\uff09\u662f\u5426\u5b58\u5728\u4e0d\u5b9c\u6062\u590d\u94fe\u63a5\u7684\u5176\u4ed6\u60c5\u5f62\u3002<\/p>\n\n<h2 class=\"wp-block-heading\"><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); color: #705b90;\">7. \u7ed3\u8bba<\/mark><\/h2>\n\n<p>Intellectual property rights such as patents are powerful means for market competition or cooperation. How to make good use of intellectual property rights such as patents in market activities is an important part of the normal operation of market economic activities. In this case, if the patent owner&#8217;s patent is finally declared invalid, the defendant will obtain huge profits during the November 11 promotion period; but if the patent owner&#8217;s patent is finally maintained valid, the defendant&#8217;s product involved in the case infringes the defendant&#8217;s rights, and the defendant&#8217;s reverse behavior preservation will cause the defendant to suffer a huge blow.<\/p>\n\n<p>\u539f\u6587\u94fe\u63a5\uff1a<a title=\"\" href=\"https:\/\/mp.weixin.qq.com\/s\/AK5glHhANcNUajvY6o4iiA\" target=\"_blank\" rel=\"noopener\">\u7528\u597d\u7535\u5546\u4e13\u5229\u4fb5\u6743\u7ea0\u7eb7\u4e2d\u7684\u53cd\u5411\u884c\u4e3a\u4fdd\u5168<\/a><\/p>\n\n<p>\u5173\u4e8e\u6211\u4eec\uff1a<a title=\"\" href=\"https:\/\/bulu-ip.com\/en\/contact\" target=\"_blank\"
