Deere\u6848<sup>ii<\/sup>&nbsp;\u5236\u5b9a\u7684\u5224\u65ad\u6807\u51c6\u3002<\/p>\n<p><\/p>\n<p><\/p>\n<p>\u957f\u671f\u4ee5\u6765\uff0c\u8bbe\u8ba1\u4e13\u5229\u7684\u663e\u800c\u6613\u89c1\u6027\u8bc4\u4f30\u9075\u5faa\u7684\u662fRosen-Durling\u6807\u51c6\uff0c\u5176\u6d41\u7a0b\u5206\u4e3a\u4e24\u4e2a\u6b65\u9aa4\uff1a<\/p>\n<p><\/p>\n<p><\/p>\n<p>1. Find an existing design that is &#8220;basically the same&#8221; as the claimed design;<\/p>\n<p><\/p>\n<p><\/p>\n<p>2. color: #705b90;\">1.&nbsp;Scope and Content of Prior Art.<\/mark><\/em><\/strong><\/em><\/strong><\/h2>\n<p><\/p>\n<p><\/p>\n<p><em><u>\u8bbe\u8ba1\u4e13\u5229\u7684\u663e\u800c\u6613\u89c1\u6027\u5224\u65ad\u4f9d\u7136\u4f9d\u8d56\u4e8e\u4e00\u4e2a\u89c6\u89c9\u4e0a\u63a5\u8fd1\u7684\u73b0\u6709\u8bbe\u8ba1\uff0c\u5373\u4f7f\u8be5\u73b0\u6709\u8bbe\u8ba1\u5e76\u975e\u201c\u57fa\u672c\u76f8\u540c\u201d\u3002\u76f8\u5173\u7684\u73b0\u6709\u8bbe\u8ba1\u5fc5\u987b\u4e0e\u88ab\u4e3b\u5f20\u7684\u8bbe\u8ba1\u5c5e\u4e8e\u76f8\u540c\u9886\u57df\u6216\u662f\u7c7b\u4f3c\u6280\u672f\u9886\u57df\u3002<\/u><\/em><\/p>\n<p><\/p>\n<p><\/p>\n<p><strong>\u7406\u89e3\uff1a<\/strong> \u5728\u8bc4\u4f30\u4e00\u4e2a\u8bbe\u8ba1\u4e13\u5229\u662f\u5426\u663e\u800c\u6613\u89c1\u65f6\uff0c\u9700\u8981\u5ba1\u67e5\u73b0\u6709\u8bbe\u8ba1\u4e2d\u5728\u89c6\u89c9\u4e0a\u4e0e\u88ab\u4e3b\u5f20\u8bbe\u8ba1\u63a5\u8fd1\u7684\u4e3b\u8981\u53c2\u7167\u7269\u3002\u8be5\u53c2\u7167\u7269\u9700\u8981\u5c5e\u4e8e\u4e0e\u88ab\u4e3b\u5f20\u8bbe\u8ba1\u76f8\u540c\u7684\u6280\u672f\u9886\u57df\uff0c\u6216\u8005\u662f\u7c7b\u4f3c\u7684\u76f8\u5173\u9886\u57df\u3002<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\"><strong><em><strong><em><mark class=\"has-inline-color\" style=\"background-color: rgba(0, 0, 0, 0); of the evaluation, and the role of these factors may be more prominent under the guidance of LKQ.<\/p>\n<p><\/p>\n<p><\/p>\n<p>After the LKQ case, the United States Patent and Trademark Office (USPTO) will guide the Patent Trial and Appeal Board (PTAB) and examiners on how to apply Graham to the obviousness judgment of design patents.
