迈瑞 和 科曼 是具有竞争关系的两家医疗设备厂商，主要产品都是重症监护ICU中用到的监护仪。双方早在2014年就已经开始激烈的商战，争夺的高地是监护仪市场（年销售额30亿的）和重症监护ICU设备市场（年销售额百亿），核心武器就是包括专利在内的各种知识产权。

据不完全统计，2014-2024十年间双方发起了22起专利侵权诉讼（伴随更多专利无效宣告），除此之外还有侵犯商业秘密、名誉权等方面的诉讼，可谓缠斗十年。

最近，因迈瑞的一项已经期限届满的专利被科曼再次被请求宣告了全部无效（该专利共被提起过7次无效宣告请求），将二者的争斗又拉回公众视线。专利诉讼表面上与技术保护有关，实质上是市场竞争。
